The H1B visa is most sought for with many Indians applying for it. However, Trump administration had made it difficult to get an H1B visa with denial rate increasing to a great extent.
However, if you are denied an H1B visa there are other options which one can apply for and is usually not aware of it. Below are the options you might consider in such a situation.
1. O Visa -
An O visa is a classification of non-immigrant temporary worker visa granted by the United States to an alien "who possesses extraordinary ability in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements".
2. E1 and E2 visa
It is intended for "priority workers". Those are foreign nationals who either have "extraordinary abilities", or are "outstanding professors or researchers", and also includes "some executives and managers of foreign companies who are transferred to the US".It allows them to remain permanently in the US.
3. TN visa
TN visa (Trade NAFTA) is a special non-immigrant status in the United States, Canada, and Mexico that offers expedited work authorization to a citizen of these countries. Within the TN set of occupations, a United States, Canadian, or Mexican citizen can work in one of the other two countries for up to three years. The permit may be renewed indefinitely.
4. Curricular Practical Training
Curricular Practical Training (CPT) is temporary employment authorization for F-1 visa non-immigrant foreign students in the United States while enrolled in a college-level degree program. CPT permission is granted through the institution's International Students Office or equivalent upon approval of the advisor, pursuant to regulations established by the United States Citizenship and Immigration Services.
