It’s Urgent: OPT to find H-1B employers by Dec 31st
USCIS recently published a proposed rule that would change the process for submitting H-1B cap petitions that opens April 1st.
The change has been made to boost the number of H-1B recipients with a Master’s degree or higher from US institutions by 16 percent.
But the advance preparation is important to ensure a complete H-1B petition to file with USCIS on April 1st.
The proposed rule would require petitioners to register electronically with USCIS during a designated registration period that is at least 14 calendar days long prior to April 1st.
USCIS would give at least 30 days advance notice before the opening of the registration period.
On April 1, 2019, USCIS will begin accepting cap subject H-1B petitions for a start date of October 1, 2019 (FY2020).
Due to the high demand for H-1B visas and newly proposed rulemaking for cap-subject petitions, employers should work on it now and identify any employees who require first-time H-1B sponsorship.
