70 H1B Indians are suing the US government!
Nearly 70 Indian citizens are suing the US government on the grounds that their H-1B visa denials were unfairly justified by unethical behavior on the part of their employers.
These individuals claim they were unfairly punished for their employers' misbehavior. They were hired under a training program for foreign graduates of US colleges.
The plaintiffs contend that the Department of Homeland Security wrongfully refused them H-1B visas despite their subsequent legal employment in their complaint, which was just filed in a federal district court in Washington state.
The lawsuit claims that the agency overstepped its bounds by refusing to give the plaintiffs a chance to refute the charges of fraud before deciding whether or not to admit them.
The agency allegedly broke the Administrative Procedure Act by failing to inform the visa applicants of the steps taken against them.
The lawsuit draws attention to a bigger problem, which is that foreign students with F-1 visas who participate in the Optional Practical Training program encounter difficulties because of scams carried out by their employers.
