Bandi Sanjay's arrest appeal heard by Telangana HC
Telangana High Court on Thursday to contest the judicial custody of Bandi Sanjay Kumar, the head of the BJP in the state and a member of parliament from Karimnagar.
The state BJP leader and Karimnagar MP Bandi Sanjay Kumar had his judicial detention in the 10th class question paper breach case challenged in a midday motion plea submitted in the Telangana High Court on Thursday.
Bandi Sanjay's attorneys petitioned the High Judge for an urgent hearing the day after he was ordered held in judicial detention for 14 days by a judge in the Warangal district.
Chief Justice Ujjal Bhuyan will hear the appeal for a lunch break.
Bandi Sanjay is the primary suspect in releasing a Hindi question paper from an SSC test location in Kamlapur, Warangal district, on Tuesday, according to the police.
The Karimnagar lawmaker was taken into custody from his in-laws' home on Tuesday night amidst much commotion. The BJP, in response, declared the detention unlawful and organised demonstrations.
Bandi Sanjay was arrested and transported to a police post in the Yadadri Bhuvanagiri region before being transferred to Warangal later that day. Due to the court vacation on Wednesday, he was turned over to authorities at the Hanamkonda home of the First Class Magistrate. The judge heard arguments from both parties and ordered him held in judicial detention until April 19.
On Wednesday night, Bandi Sanjay was transferred to the prison in Karimnagar.
The police charged Bandi Sanjay with conspiring with other suspects to distribute a copy of the 10th-grade exam.
The authorities have detained five of the ten suspects and issued a summons to appear in court to a minor, a 10th-grade pupil.
Moutam Shiva Ganesh, Bandi Sanjay, Boora Prashanth, and Gundaboina Mahesh have all been taken into custody.
Subash Pogu, Shashank Pogu, Srikanth Dhoolam, Shramik Perumandla, and Varsith Pothanaboina have all vanished.
They have been charged with violations of 120B (criminal plot), 420 (cheating), and 505 of the Indian Penal Code. The police have also cited provisions 66-D of the IT Act and 4 (A) and 6 of the TS Public Examinations (Prevention of Malpractices) Act.
On Wednesday, A. V. Ranganath, the police commissioner of Warangal, informed the media that Bandi Sanjay had declined to hand over his phone to the police and had erased a large amount of information. Ranganath questioned why he would be concealing the phone if the man were truly innocent.
The commissioner assured us that even if we erased our phone and text logs, we could get them back. He said we'll contact WhatsApp and the phone company to see if we can get our information back.
The head of the police department claimed this was all part of a larger plot to discredit the government and water down the testing procedures.
