US Clarifies $100,000 H-1B Visa Fee: Major Relief for Indian Students and Tech Professionals
In a major development for Indian students and tech workers, the United States Citizenship and Immigration Services (USCIS) has issued detailed clarifications on the controversial $100,000 (approx ₹88 lakh) H-1B visa fee introduced last month under a presidential proclamation by the Trump administration. The announcement brings significant relief and clarity to thousands of applicants, particularly those already living in the US.
According to the USCIS, the hefty fee will not apply to individuals changing their immigration status within the country—such as international students moving from F-1 to H-1B visas. This exemption benefits a large number of Indians, who make up nearly 70% of H-1B visa holders and 27% of all international students in the US in 2024. Immigration experts say the clarification ends weeks of uncertainty for both employers and visa applicants.
The USCIS further confirmed that the proclamation does not cover existing visa holders, extensions, or petitions filed before September 21, 2025. H-1B professionals can continue to travel in and out of the US freely, and petitions requesting amendments or extensions for individuals already in the country will not incur the new fee. However, the rule will apply to new applicants filing from outside the US.
In rare instances, the Department of Homeland Security may grant fee waivers if no qualified American worker is available or if the job serves the national interest. Employers must pay the fee via pay.gov before filing, or risk petition rejection.
The clarifications come amid a lawsuit filed by the US Chamber of Commerce challenging the legality of the fee, which critics say unfairly burdens small companies and foreign talent. For now, the USCIS guidance provides much-needed assurance to Indian graduates and professionals charting their future in the United States.
