The US Citizenship and Immigration Services (USCIS) has issued new guidelines for the EB-1 category of green cards, which are designated for individuals who can demonstrate extraordinary ability in fields like science, arts, education, business, or sports. These updates aim to broaden the criteria and provide greater clarity for applicants seeking to qualify under this prestigious visa category.
Frustrated by the years-long backlogs in employment-based categories such as EB-2 (for advanced degree holders) and EB-3 (for skilled workers), many Indian professionals with a STEM background are turning to the EB-1A subcategory. According to data from the National Foundation for American Policy (NFAP), as of November 2023, only 140,000 Indians were in line for an EB-1 green card, compared to over a million waiting under EB-2 and EB-3 categories combined.
The updated USCIS guidance outlines the types of evidence that can be submitted to prove extraordinary ability. Notably, team awards will now be recognized as part of the ten evidentiary criteria, provided the applicant is named as a recipient. Additionally, past memberships in exclusive professional associations will be accepted, though the applicant's sustained acclaim may be scrutinized based on the time elapsed since membership. Changes to publication criteria have also been introduced, removing the requirement for published work to specifically highlight the value of the applicant’s contributions.
