The US will issue employment credentials for five years
Several non-immigrant categories, including those awaiting green cards, will be issued employment authorization certificates by the United States for a period of five years. This initiative would benefit thousands of Indians residing in the country. Certain noncitizens who are required to file for employment authorization will have their maximum validity period of Employment Authorization Documents (EAD) extended to five years, according to US Citizenship and Immigration Services (USCIS).
This increase applies to both initial and renewal EADs. The federal agency stated that these include individuals seeking asylum or having their removal withheld, adjusting their status under INA 245, suspending their deportation, or having their removal canceled.
It is stated that by increasing the maximum validity period of Employment Authorization Documents (EADs) to five years, the agency can substantially decrease the influx of new Forms I-765, Application for Employment Authorization, submitted for renewal EADs in the coming years. This will aid in the agency's endeavors to decrease processing times and backlogs associated with EADs. It was stated, however, that the noncitizen's ability to maintain employment authorization is contingent on their underlying status, circumstances, and EAD filing category.
An individual's ancillary employment authorization may be terminated prior to the expiration date specified on the EAD, the provision stated, if the adjustment application is subsequently denied after the individual obtained an EAD under the category contingent on a pending adjustment of status application for the maximum validity period of five years.
